Welcome to CTF Designs ("we," "us," or "our"). These Terms of Use govern your access to and use of our website (ctfdesigns.com) and the services we offer, including our free website audit. By using our site or requesting a service, you agree to these Terms. If you do not agree, please do not use the site.

1. Acceptance of These Terms

By accessing this site, submitting a form, or requesting any service, you confirm that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy Terms of Use.

2. Our Services

We provide web design, development, branding, and related digital services. Specific project scope, pricing, timelines, and deliverables are defined in a separate written agreement. Nothing on this site is a binding offer; a client relationship begins only when both parties sign a written agreement.

3. Free Website Audit

Our free website audit is a complimentary, no-obligation service offered as a marketing tool to introduce prospective clients to our work. By requesting an audit, you understand and agree that:

  • It is provided free of charge, with no obligation to purchase anything;
  • It is a marketing and informational service, not professional, legal, financial, or accessibility-compliance advice;
  • Findings may be generated in part using automated tools and reflect our opinion at a single point in time;
  • We do not guarantee the accuracy or completeness of any finding, or any specific results, rankings, or business outcomes;
  • Requesting or receiving an audit does not create a client relationship until a separate written agreement is signed;
  • You represent that you are authorized to request an audit of the website you submit; and
  • Any accessibility or ADA observations are limited to publicly visible, front-end design flaws, are not a legal compliance assessment, and are no substitute for a full audit, we strongly recommend a comprehensive accessibility/ADA audit conducted by a qualified attorney; and
  • We may contact you about our services in connection with your request.

4. Paid Packages, Payment & Revisions

For paid packages and design services (including the Launch Kit and any à la carte design work), the following terms apply in addition to any separate written agreement:

  • Payment upfront. Payment is due in full before work begins. We start a project only after payment has been received.
  • Revisions. Each package includes a set number of revision rounds — the Launch Kit includes three (3) revisions. A “revision” is one consolidated round of written feedback. Additional revisions beyond the included amount may be quoted and billed separately.
  • Non-refundable. Because work begins promptly and involves custom creative effort, payments are non-refundable once work has begun.
  • Deliverables & ownership. Final files and ownership of the completed deliverables transfer to you upon full payment and completion.
  • Timelines. Turnaround estimates are made in good faith but are not guarantees, and depend on your timely provision of content, feedback, and approvals.
  • Your materials. You confirm you have the rights to any content, logos, or assets you provide, and that we may use them to deliver your project.

5. Intellectual Property

All content on this site that belongs to us, including our logo, branding, copy, and designs, is our property or licensed to us and may not be copied or reused without permission. Content and materials you provide to us remain yours; you grant us the limited right to use them to deliver the requested service.

6. Acceptable Use

You agree not to misuse the site, submit false information, request audits of websites you are not authorized to submit, attempt to disrupt the site, or use it for any unlawful purpose.

7. Third-Party Links & Tools

Our site and audits may reference third-party websites or use third-party tools (such as performance and analytics services). We are not responsible for the content, policies, or availability of third-party services.

8. Disclaimers

The site and the free audit are provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law.

9. Limitation of Liability

To the fullest extent permitted by law, CTF Designs is not liable for any indirect, incidental, or consequential damages arising from your use of the site or the free audit. Our services under any signed agreement are governed by the terms of that agreement.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the site after changes are posted constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the State of California, and any disputes will be handled in Riverside County, California.
